Terms & Conditions

Terms and Conditions for Nourish Ibiza, by Gabriella Delellis

1. **Booking Confirmation:**

- A booking is considered confirmed upon receipt of a signed contract and a

non-refundable deposit of 50% of the total booking cost or as otherwise agreed upon.

2. **Payment Terms:**

- A non-refundable deposit of 50% is required upon booking to secure the date. The

remaining balance is due 30 days prior to the event.

- Payments can be made via bank transfer or as specified in the invoice. All payments

must be made in euro €.

3. **Cancellation Policy:**

- Cancellations made 30 days or more before the event will result in the forfeiture of the

deposit.

- Cancellations made less than 30 days before the event will result in the forfeiture of the

full payment.

4. **Menu Selection and Changes:**

- Menu selections must be finalised no later than 60 days prior to the event.

- Any changes to the menu must be communicated at least 30 days prior to the event and

may be subject to additional charges.

5. **Variations to the price**

a. Where children are attending; if over 11 years of age they are payable at the same

rate as adults. If aged 3- 10 years of age they are chargeable at half the adult price.

Children under 3 years old will be free of charge.

b. Menu selections for children must be discussed with Nourish as soon as

possible and the invoice can be revised accordingly. Chosen meals from the Kids

Menu are limited to 2 options only.

c.Rates for inflation will be charged at 5% per year, and discussed in advance with

the client. If the event is postponed , this fee will be applied to the new invoice.

We cannot guarantee the staffing fee’s will remain the same throughout the year

as this amount fluctuates and the only non-fixed cost.

d. Outside of the menu cost, we will apply a set up/breakdown fee relevant to the

venue. This will cover transport, external supplier set up costs, manpower to

create a pop up kitchen suitable to service your event.

6. **Guest Count:**

- The final guest count must be confirmed no later than 30 days prior to the event. Any

decreases in guest count after this deadline will not result in a reduction in the final

invoice.

7. **Venue Access and Requirements:**

- The client is responsible for securing appropriate venue access and necessary permits

for the event. The caterer must be informed of any venue restrictions or requirements.

- The caterer requires access to the venue for setup at least 6 hours prior to the event

start time and 4 hours for breakdown after the event. On the occasion that check-in is the

same day as the event, we will require access prior to check-in time, or the day before and

this will need to be arranged directly with the venue via the client or event planner.

8. **Menu, Allergies and Dietary Restrictions:**

- The client must provide information regarding any allergies or dietary restrictions of

their guests at least 30 days prior to the event. The caterer will make reasonable efforts to

accommodate these requests.

- The Parties have agreed to the menu in the final proposal. Nourish reserves the right to

make small changes to the menu if key ingredients are unable to be sourced due to reasons

beyond the control of the parties. The following limitations will apply to this reservation of

rights.

9. **Clients Food and Drinks**

a. Nourish accepts no liability for any food supplied to the client by another

caterer, or food products supplied by the client themselves, in addition to those

arranged by Nourish.

Where the Client has made additional arrangements (such as third party drinks)

Nourish will require written notice no later than one month prior to the event.

B. Nourish will happily serve a client's arrival drinks, table wines etc. during their

event subject to waitress fees or corkage, please ask for further details.

10. **Liability:**

- The caterer is not liable for any damages, losses, or injuries incurred during the event,

except those caused by gross negligence or willful misconduct.

- The client is responsible for any damages to equipment or property caused by their

guests during the event.

11. **Force Majeure:**

- The caterer shall not be liable for any failure or delay in performance due to

circumstances beyond their control, including but not limited to acts of God, natural

disasters, war, or governmental actions, missed or cancelled flights.

​

12. **Jurisdiction:**

- These terms and conditions shall be governed by and construed in accordance with the

laws of Ibiza. Any disputes arising out of or in connection with these terms and conditions

shall be subject to the exclusive jurisdiction of the courts of Ibiza.

**Acceptance of Terms:**

By signing the contract or confirming the booking electronically, the client acknowledges

that they have read, understood, and agreed to abide by these terms and conditions
